On November 10, the Association’s Art Law Committee will present “Transforming Art: Fair Use Issues,” an informative and provocative public program for audiences interested in visual art or intellectual property law.

Artists historically have drawn imagery and subject matter from each other and the world at large, and they continue to do so. Contemporary art incorporates references to other art and media images, as well as to commercial logos, symbols and products. Reproductions of art today also are widely published and used in advertising and on merchandise.

But in recent years, and particularly as our culture has gone digital, conflicts have escalated between owners and users of copyrighted images and trademarks. How well does the legal doctrine of fair use serve the varied interests at stake? When is the act of copying legitimate and even creative, and when is it legally regarded as piracy? Following presentations on contemporary visual art practices and the relevant law, a distinguished panel will discuss the current state of affairs and proposals for change.
