I. Schedule
The House and Library are open for members Monday through Saturday. The House and Library are closed on Saturday during the months of July and August; they re-open on the first Saturday following Labor Day. The House and Library are closed on New Year’s Day, Martin Luther King Day, President’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving and Christmas.

II. Use of Building
The Library, stacks and reading rooms are for the sole use of members, or of those persons who have been granted the privileges of the House and Library under the provisions of By-Law XXV. Members may personally show guests through the building but may not extend to such guests any of the privileges of the Association, except as provided in By-Law XXV. Requests for Library privileges under By-Law XXV, Section 3, must be made by a member of the Association.

III. Conduct
1. No person who enters the House of the Association shall unreasonably interfere with other persons’ use of the Association, or engage in behavior which is disruptive of the activities of the Association.

2. The President or Executive Director, or any officer or employee designated by either of said officials, shall have the authority to utilize any lawful means to cause the removal from the House of the Association of any person who violates the provisions of paragraph 1.

IV. Conference Room
A conference room in the House of the Association may be assigned by the Director of Meeting Services to a member on request in accordance with the rules set forth below:

1. No room in the House of the Association shall be assigned to any member or group for other than Association purposes, except with the authority of the Executive Director.

2. A member to whom a room is assigned shall be personally responsible for the charge therefore, and for the payment of other charges incurred by any person not a member of the Association who is in the House of the Association in connection with the use of such room.

3. A member to whom a room is assigned shall see that it is used in accordance with the rules established for the House and Library, and that such use shall in no way interfere with the comfort or convenience of other members or with the dignity of the Association.

4. A member shall not use a room in such manner as to make it appear that the Association is in any way committed to, or connected with, the purpose for which the meeting in the room is held, but this provision shall not apply to the use of a room by any committee of the Association.

5. Broadcasting or telecasting from a room or the taking of motion pictures therein shall not be permitted without first obtaining the permission of the Chair of the House Committee, or the Executive Director.

6. The use or assignment of a room may be terminated at any time by the Director of Meeting Services. Persons aggrieved by the decision may seek review by the Executive Director.

7. Charges shall be made at the discretion of the Executive Director for the use of conference rooms. The Executive Director may assign these rooms without charge to the judges of courts of the State of New York and of the Federal courts. The rates fixed for conference rooms are available in the Office of the Meeting Services Department.

8. Where a room is assigned for a specific period, the applicant shall be charged for the room for such period; but on notification of cancellation by the applicant five business days prior to scheduled assignment, no charge will be made. Cancellation after that time will result in a 50% room fee charge.

Failure on the part of a member to comply with any of the above rules shall be deemed misconduct in the member’s relations to the Association within the meaning of By-Law XX.

V. Employees
1. Members shall not give money or gratuities of any kind to any employee of the Association.

2. Members are requested to report to the Executive Director or the Director of Library Services, as the case may be, any inattention, discourtesy or misconduct by any employee.

VI. Smoking
Smoking is not permitted in the House of the Association.

VII. Complaints
Complaints or suggestions with regard to the management of the House or the Library should be made in writing to the Executive Director or the Director of Library Services.

VIII. Personal Property Left at the House of the Association
1. Personal property may be checked by members or by guests in the checkroom, but only on condition that a check is issued therefore.

2. If any property remains unclaimed for thirty days, it will be disposed of as directed by the Director of Building Services.

3. This service is provided without charge as an accommodation for members and guests, but the Association will in no case be responsible for theft, loss or damage to personal property.

IX. Use of Association’s Address
No member shall use the address of the House of the Association as an office address in advertisements, legal papers, directories, or for the receipt of personal mail, unless approved in writing by the President.

X. Rules for the Use of the Associations’ Address List
The list of members of the Association or any part thereof, may be purchased by, or on behalf of, members to address announcements or descriptive materials regarding themselves or their firms. Said list may also be sold or otherwise made available, at the discretion of the Executive Director or President, for purposes germane to the activities of the Association, or such other uses as the Executive Director or President may deem appropriate, provided that said list shall not be sold to or used by anyone for the solicitation of contributions for any purpose or other than for the purposes of the Association. No purchase or other use of the list of members of the Association shall be made until the form and substance of the matter to be sent out has been submitted to, and approval has been granted by, the Executive Director or the President, who may consult with the Committee on Professional and Judicial Ethics or other Association committees with regard to the content of the materials to be mailed.

XI. Library
1. The Director of Library Services shall have charge of the Library and of all the departments thereof, subject to policy guidance by the Library Committee and administrative supervision of the Executive Director.

2. The Director of Library Services shall be responsible for the proper care and management of the Library and shall from time to time report to the Library Committee.

3. Either the Director of Library Services or a qualified assistant shall at all times be on duty in the Library.

4. Members may not reserve desks in the Library for a period longer than twenty-four hours.

5. Conversation in the Library is prohibited. Dictation and the use of stenographic equipment shall be permitted only in conference rooms.

6. Members may suggest purchases of books not in the Library collection by writing to the Director of Library Services.

7. No book or other article belonging to the Association shall be removed from the House except as provided in By-Law XXVI.

8. Library personnel must restore all books to the shelves.

9. No more than two volumes from the Library Reading Rooms or stack rooms may be taken by or for any member to the first or second floors, unless such material is for use at an Association committee meeting.

XII. Regulations for the Production of Books of the Association in Court
1. Books in the Library of the Association may, for use as evidence, be produced at the request of any member of the Association who shall be either a party, or an attorney of record, or of counsel in an action or proceeding for use in which such book shall be desired in a court in the City of New York; or with the express consent of the Chair of the Library Committee, and under such conditions as the Chair may prescribe, in a court elsewhere in the City of New York, or in the United States District Court, District of New Jersey, sitting in Newark.

2. A member desiring the production of a book shall personally give twenty-four hours notice in writing to the Director of Library Services, specifying the action or proceeding in which the book is intended to be used, the court in which such proceeding is pending, and the time and place at which the production of the book is desired. Any member making such request shall be deemed thereby to agree to pay to the Association the value of the books not returned as fixed by the Library Committee in accordance with Section 6 of this article.

3. Upon receiving such written request, the Director of Library Services may deliver the book to the person requesting it. If, in the judgment of the Director of Library Services, the value of the book so warrants, the member shall pay the sum of ten dollars for the expenses of production, and, in that case, the book specified in the notice shall be produced in accordance with the notice by the Director of Library Services, or an Assistant, or an employee of the Association designated by the Director of Library Services.

4. Any book delivered to a member shall be returned within twenty-four hours after such delivery, or, if produced in court by the Director of Library Services or an Assistant or employee, to the custody of the person producing the same at the close of the session of the court on the day when it was produced.

5. The Director of Library Services shall have power, on written request, to extend the time for the return of a book taken by a member for use as evidence. Ten dollars per day will be charged for each successive day’s extension.

6. For failure to return such books as herein provided, the member to whom such book shall be delivered, or at whose request such book shall be produced, or any other member of the firm to which the member shall belong, shall not thereafter be entitled to the production in court of books from the Library until the further order of the Library Committee, and in case such book shall not be returned to the Library or to the custody of the person producing such book on behalf of the Association, within three days after the expiration of the time limited by these rules, the member to whom such books shall have been delivered or at whose request it shall have been produced shall also pay to the Association the value of such books as fixed by the Library Committee. Failure to make such payments shall be deemed misconduct by the member in the member’s relations to the Association and shall be presented by the Library Committee to the Committee on Professional Discipline for its action.

7. Before the production in court of any book, the member to whom it is delivered, or on whose request it shall be produced, shall make for use as exhibits full copies of so much of such book as may be sought to be offered in evidence, and such copies and not the book must be marked as exhibits. Such book after having been offered in evidence must be returned to the Library or to the custody of the person producing such book on behalf of the Association.

XIII. Rules for the Admission of Members’ Employees to the Use of the Library
1. Employees of members will be admitted to the use of the Library upon presentation of Employee’s privilege slips.

2. Employee’s privilege slips, either daily or in books of ten, may be purchased by members from the Office of Library Administration, subject to such fees as the Executive Committee may establish from time to time, as recommended by the Library Committee.

3. Each Employee’s privilege slip shall be signed by the member, countersigned by the employee, and presented at the reference desk in the Library which entitles the employee to use the Library for one day or any part thereof.

4. A member shall be responsible for the proper conduct of and for all charges incurred by employees introduced by the member under this rule.

XIV. Library Privileges
1. Persons who are graduates of law schools, but who are not eligible for any class of membership, may be granted the privilege of using the Library upon application to the Director of Library Services. The Library privilege shall be allowed by the Director of Library Services for a period of six months, upon the payment of such fees as the Executive Committee may establish from time to time, as recommended by the Library Committee.

2. Each applicant for the Library privilege shall be sponsored by a member of the Association, who shall state in writing the nature and extent of such member’s acquaintanceship with the applicant and such other information as may be required by the Executive Committee, as recommended by the Library Committee.

3. The Library privilege may be renewed.

4. Persons who are students in good standing at a law school and are employed by a member of the Association may be granted the privilege of using the Library during the summer recess.

5. The Summer Library privilege shall be allowed for the period May 1 to September 1, upon the payment of such fees as the Executive Committee may establish, as recommended by the Library Committee.

6. Members wishing to obtain the Library privilege for an eligible person should request it in writing, to the Director of Library Services, accompanied by the appropriate fee.
